Terms and Conditions:
Please carefully read these terms and conditions before opting into any services, courses or programs. By executing these terms and conditions, you consent to be governed by the following provisions:
PARTIES: Throughout these terms and conditions, 'you/your' refers to the client. The facilitator/practitioner/coach, Elise Rose Small of One 2 Breathe Wellness Co, ABN 26 753 790 462, will be referred to as ‘the facilitator and/or legal name as stated above, throughout.
Overview: These terms and conditions, applicable to individual sessions, packages, courses, programs and events, encompass the service description, medical questionnaires, and any other relevant correspondence found on the facilitator's website or booking platforms such as Kajabi, Acuity:Scheduling and Humantix. This includes, but is not limited to, Kajabi, Humantix and Acuity:Scheduling Ticketing terms and the Humantix and Acuity:Scheduling Privacy Policy.
Please refrain from opting in until you have reviewed and agreed to abide by the Terms and Conditions governing your attendance and participation.
1. Client Obligations
1.1 By attending your session/event, you confirm that you are 18 years of age or older.
1.2 You have disclosed any pertinent medical history/conditions that may affect your ability to participate.
1.3 You acknowledge and accept that every participant/session may yield differing physical, emotional, or spiritual outcomes.
2. Payment:
2.1 The specific cost and inclusions of the service or event will be outlined in the service/event description.
2.2 Full payment is required at the time of booking. Higher-value packages may be paid in instalments at the facilitator's discretion, as agree upon during consultation.
2.3 In addition to the specified prices, you are responsible for GST and any applicable booking, handling, credit card surcharge, or postage fees.
2.4 Any additional costs related to the service or event are your responsibility.
3. Refunds and Credits
3.1 All service costs are final, and no exchanges or refunds will be provided except in the event of a cancelled service or event without a rescheduled date.
3.2 Refunds or credits are at the discretion of the facilitator and are subject to discussion based on reasonable grounds.
3.3 Any credits issued will expire after three months, and a new fee will be charged for future bookings of services or events.
4. Cancellation of Service or Events
4.1 The Facilitator reserves the right to cancel, postpone, or significantly alter the service/event due to circumstances affecting either party, the venue, or other relevant stakeholders.
5. Cancelled Service or Events
5.1 In the rare event of a cancellation with no rescheduled date, you may choose, within 30 days of notification, to receive a refund minus booking fees and additional expenses.
5.2 Failure to submit a request within 30 days will result in your ticket credit automatically being transferred to the new date for the postponed event.
6. Postponed Events
6.1 If a service or event is postponed or rescheduled to a different date, you may submit a written request within 30 days of the rescheduling notice for a credit equal to the price paid. This credit can be applied towards the rescheduled event or another event occurring within three months of the original date.
6.2 Failure to advise within 30 days will result in your credit for the ticket automatically being transferred to the new date for the postponed event.
7. Intellectual Property
You agree to the following:
7.1 The Facilitator retains all intellectual property (IP) rights in Elise Rose Small's materials.
7.2 These terms and conditions do not grant you any IP rights in Elise Rose Small's materials.
Elise Rose Small agrees to the following:
7.1.1 You retain all IP rights in all participant materials.
7.1.2 These terms and conditions do not grant Elise Rose Small any IP rights in any participant materials.
Neither party shall engage in any conduct that may compromise or challenge the other party’s IP rights in the materials belonging to the other party, whether it be that of the participant or Elise Rose Small.
8. Privacy and Confidentiality
8.1 You acknowledge that information collected about you during onboarding and through forms for services and events will be held by Elise Rose Small for the purpose of facilitating and hosting events.
8.2 The facilitator does not sell or trade any personal information but may use it in an anonymised form for marketing statistics, event planning, and meeting overall needs.
8.3 Information may be disclosed in good faith and where required, such as:
- If ordered by the court
- To enforce the terms of any agreements as outlined
- To protect the rights, safety, or property of Elise Rose Small, the client, or third-party associates
- To financial institutions or banks for the prevention of fraud or as proof of transactions
8.4 Each party must keep all confidential information confidential and must exercise the same degree of care in protecting disclosed information.
9. Media Release and Consent
9.1 Before and during your session or event, you acknowledge and agree that you may be subject to photographs, videos, sound recordings, or other media captures of your face, name, and voice for advertising or social media purposes.
9.2 You consent to the use, publication, distribution, reproduction, live-streaming, posting, and digitization of any released media for legal purposes, including but not limited to social media, commercial products, education materials, sales, marketing, or any other media.
9.3 You understand that the facilitator may use all released media at their discretion, and you do not have the right to inspect or approve its use.
9.4 By agreeing to these terms, you release the facilitator from any claims or demands arising from the use of released media, including claims related to intellectual property rights. You do not claim ownership of the released media and waive any opportunity, past or present, to copyright or trademark any released media.
10. Personal Injury
10.1 As a participant in sessions and events, you acknowledge that you will be exposed to normal risks associated with breathwork and healing modalities. You will be provided with onboard information and informed of all associated risks through the medical questionnaire.
10.2 Furthermore, you acknowledge and agree that due to the nature of these modalities, it would be unreasonable for the facilitator to be held responsible for any damages, injury, or death. Therefore, to the fullest extent permitted by law, you waive all legal rights of action against and fully release Elise Rose Small from any loss, damages, injury, or death arising from your participation in or attendance of events.
